Microsoft Gets Sued! The Sequel
Last week we told you about the absurd lawsuit regarding the Florida man who sued Microsoft because, he claims, his Xbox 360 has been scratching his discs beyond repair. Anyone who has been reading this site on a regular basis knows that I consider the original lawsuit to be little more than trash. BUT, apparently someone tasted the blood in the water, and another lawsuit has been filed against Microsoft for the same damn problem.
This time, it’s two folks from California. Christine Moskowitz and Dan Wood filed their complaint this past Monday, and according to court documents they are seeking no less than $5 Million in damages.
…I told you it was a bad day…
Christine Moskowitz purchased an Xbox 360 in March of 2006, along with Gears of War, Crackdown and Saints Row. (It should be noted that, while the report reads that she purchased those titles with the Xbox in March of 2006, none of those titles were on the market) Within months of the purchase, she claims that the discs were damaged via circular scratching to the point where they would no longer work properly.
Wood’s lawsuit is for the same cause, however he did not describe the damage to his copy of Splinter Cell.
Both Wood and Moskowitz claim that it was Microsoft’s desire to beat Sony and Nintendo out the door that has warranted these issues. Their lawsuit reads, and I quote, “Microsoft’s rush to market, while positive for Microsoft, was detrimental to consumers because the Xbox 360 suffered from numerous hardware defects.”
Earlier this month, Microsoft did acknowledge some design flaws with the console that related to the Ring of Death, however they made no mention to any widespread issue of disc scratching. In addition to extending their warranty to three years, Microsoft has agreed to reimburse those who paid the charges of having their Ringed-360 shipped to be repaired, which will cost Microsoft over $1 Billion.
